The Environmental protection act 1990 ( I believe it’s section 90 of the act) provides for individuals to approach the magistrates courts to obtain an abatement order to remedy statutory nuisance. This is quite separate from the local authority’s statutory enforcement role. In addition where a Local Authority is failing to discharge it’s statutory duties a writ of mandamus can be obtained from the courts to force the LA to carry out it’s statutory obligations.

I cannot understand why my visitors from Australia and the south of England are able to say there are no problems there with smells from Water Treatment Works when in the Preston and Hedon area we have to keep our windows permanently closed to keep out the smell.
It smells that putrid it actualy woke me up and I live over 2 miles away, get it sorted you anti social ********! (Oooo this was much too rude! – Ed).
I have a shop on Holderness road, I thought this might be a good place to hold a hard copy petition and a poster in the window, This would give people from the east a place to come and sign and also give the campaign maximum publicity.

the stench from the Yorkshire water plant has gone on for too long.If Yorkshire water can”t fix it.the plant should close.
i really free for the residents.must be very difficult in summer.
We live in Bilton Grange and since the plant opened on Saltend there has been an unbearable smell during the summer. It makes my family and I feel ill. It makes it very difficult in warm weather, when all you want to do is open your windows to let in some air, but you can’t because of the smell. Eating outside is also impossible. It needs to be sorted, NOW.
I don’t know about Hedon, but my wife and I have been sickened by the stench coming through our windows and my wife is a chronic asthmatic. We thought that the farmers had started tipping pig slurry on the land. Thats how bad it was. The plant should be closed down….NOW.
